Latest GST Trends: Key Updates and Highlights

GST revenue collection crossed ₹2.10 lakh crore in April 2024, the highest ever in a month, indicating the ever-growing economic growth and tax compliance in the country.

Highlights from the 55th GST Council Meeting

The 55th meeting of the Goods and Services Tax (GST) Council was held in Jaisalmer on 21 December 2024.

The event was chaired by our Union Finance Minister, Nirmala Sitharaman, and was attended by top bureaucrats, finance ministers, and chief ministers of various states and union territories of India. Here’s a few important points of this meeting

1. Potential Rate Changes: In the meeting, discussions about reducing the current GST rates for packaged drinking water, exercise notebooks, etc, and increasing the GST rates for luxury shoes, watches, and other similar commodities took place

2. Merging existing tax slabs: Simplifying the GST structure was also under discussion for the introduction of a tax slab of 35%.

3. GST Rates Revision on Insurance and Educational Goods: GST rates to be revised for insurance premiums, textiles, educational goods, and cosmetics.

Sequential filing of GSTR-7 returns has been made compulsory from 1st November, 2024 for all taxpayers to maintain consistent filing. In periods where there are no deduction, nil return is mandatory.

Biometric Aadhaar Authentication for GST Registration

On December 15, 2024, GSTN had launched biometric-based Aadhaar authentication and document verification for GST registration across states including Madhya Pradesh, Haryana, and Meghalaya.

The registration process is further secured through the use of OTP-based authentication or biometric verification for applicants.

From January 1, 2025, new rules for e-way bill and e-invoice generation:

1. Document date: The e-way bills can only be generated by the taxpayers for documents within 180 days.

2. Extending Validity: The e-way bill can be extended to 360 days, starting from the original generation date

3. Mandatory MFA/2FA on NIC portal: Multi-factor authentication would be mandatory on the NIC portal while generating e-invoices and e-way bills. Earlier, it was allowing it only for taxpayers with an annual aggregate turnover of more than ₹20 crores and will be extended to all users on a phased basis effective April 1, 2025.

Advisory on GSTR-9 Filing Discrepancies

In respect of discrepancies between Table 8A and Table 8C of GSTR-9 for FY 2023-24, GSTN has issued an advisory. Though the values in Table 8A get auto-populated from GSTR-2B, Table 8C requires even a manual entry concerning credits received in one financial year, but availed in another financial year.

This update is intended to reduce mismatches and clarify things for taxpayers.

Revised Taxation on Popcorn

Differential taxation on popcorn has emerged as a hot topic after the recent meeting of the GST Council. Here's how GST is applied:

Loose Popcorn: Sold in theatres and taxed at 5%.

GST on Branded Packaged Popcorn: 12%

Caramelized Popcorn: Sugar confectionery, taxed at 18%.

Further, when popcorn is sold along with movie tickets, a composite supply is identified which is charged at the GST rate applicable to the entry tickets. This clarification resolves state-wise differences in the taxation of popcorn.
