GST on Individual Advocates, Senior Advocates  Firm of Advocates in India

Goods and Services Tax (GST) is a comprehensive tax levied on the supply of goods and services in India. GST is applicable to all sectors and industries operating in India, including legal services. GST was introduced in India on 1st July 2017, with the aim of simplifying the indirect taxation system in the country.

Under GST, individual advocates, senior advocates, and firms of advocates are required to pay GST on the services provided by them. In this article, we will discuss GST on individual advocates, senior advocates, and firms of advocates.

Individual Advocates

Individual advocates are required to register under GST if their annual turnover exceeds Rs. 20 lakh. If the turnover is less than Rs. 20 lakh, registration is not mandatory, but voluntary registration is possible. Once registered, individual advocates need to pay GST at a rate of 18% on the services provided by them. The tax liability of an individual advocate is the responsibility of the advocate themselves.

It is important to note that advocates who provide legal services to clients outside India are not required to pay GST on those services. However, if the service is provided to a client in India, GST is applicable.

Senior Advocates

Senior advocates are also required to register under GST if their annual turnover exceeds Rs. 20 lakh. The tax liability of senior advocates is the responsibility of the senior advocate themselves. However, if the senior advocate is a partner in a partnership firm, the tax liability is shared by all the partners of the firm.

The services provided by senior advocates are taxable under GST at a rate of 18%. Senior advocates who provide legal services to clients outside India are not required to pay GST on those services. However, if the service is provided to a client in India, GST is applicable.

Firm of Advocates

A firm of advocates is required to register under GST if their annual turnover exceeds Rs. 20 lakh. The tax liability of a firm of advocates is the responsibility of the firm. The partners of the firm are jointly and severally liable for the tax liability of the firm.

The services provided by a firm of advocates are taxable under GST at a rate of 18%. If the firm provides legal services to clients outside India, GST is not applicable. However, if the service is provided to a client in India, GST is applicable.

Conclusion

GST is applicable to individual advocates, senior advocates, and firms of advocates providing legal services in India. The tax liability is the responsibility of the respective party, and the services provided are taxable under GST at a rate of 18%. It is important for advocates and firms to comply with the GST regulations to avoid any penalties or legal implications.
