All about GST Refund: A Comprehensive Guide

GST or Goods and Services Tax is one of the biggest tax reforms in India. It was introduced to subsume all the indirect taxes and create a uniform tax structure across the country. The introduction of GST has simplified the tax process for many businesses, but it has also given rise to new challenges, including GST refund. In this article, we will discuss all the important aspects of GST refund.

What is GST Refund?

GST refund is a process that allows businesses to claim back the tax they have paid on any input goods or services that were used for the production or supply of goods or services. Businesses can claim a refund on the GST paid on goods that were exported or on supplies made to SEZs (Special Economic Zones) or on supplies made to businesses that are exempted from GST. GST refund is applicable to all registered taxpayers under GST.

Types of GST refund

There are mainly two types of GST refunds – IGST and CGST/SGST.

  • IGST Refund – IGST stands for Integrated Goods and Services Tax. It is applicable on the movement of goods and services from one state to another. If a business has paid IGST while exporting goods or services, they can claim a refund on the same.
  • CGST/SGST Refund – CGST stands for Central Goods and Services Tax, and SGST stands for State Goods and Services Tax. If a business has paid CGST/SGST while exporting goods or services or while making supplies to SEZs or businesses that are exempted from GST, they can claim a refund on the same.

When can a business claim GST refund?

A business can claim GST refund under the following circumstances:

  • Export of goods or services
  • Supplies made to SEZs or businesses that are exempted from GST
  • Accumulation of ITC (Input Tax Credit) due to inverted tax structure
  • Finalization of provisional assessment
  • Miscellaneous reasons like excess payment of tax, tax paid by mistake, etc.

What are the documents required for GST refund?

The documents required for GST refund may vary depending on the type of refund. However, some of the common documents required are:

  • Invoice
  • Export declaration
  • Shipping bill
  • BRC (Bank Realization Certificate)
  • Letter of undertaking (for exports without payment of IGST)
  • Receipt voucher or payment voucher

How to claim GST refund?

The process of claiming GST refund involves the following steps:

  • File the refund application in FORM GST RFD-01 electronically on the GST portal.
  • The GST officer will scrutinize the application and may ask for additional documents, if required.
  • If the application is found to be complete and correct, the refund amount will be credited to the bank account of the business within 60 days from the receipt of the refund application.
