Section 44AD is among the most viable tax provisions that can be applied by a small business owner. It simplifies your paperwork, compliance rate and provides you with an easy option for calculating taxable income. Instead of maintaining books and calculating exact profits, the Income Tax Act lets you declare a fixed percentage of your turnover as income. That is why this plan is most popular among traders, shop owners, freelancers who have business models, or other small businesses. Let’s break it down cleanly and straightforwardly.

What is Section 44AD?

Under the Income Tax Act, section 44AD is a presumptive tax scheme. It allows small enterprises to report a portion of their turnover as income. Once you choose this scheme, you don’t need to maintain detailed books of accounts or get them audited. The law assumes that your business earns a minimum margin and taxes you on that basis.

Deemed income under Section 44AD

8 percent of turnover if the business receives payments in cash
6 percent of turnover if payments are received through digital modes like UPI, bank transfers, cards, or wallets

You can declare a higher income if you want, but not lower unless you maintain books and get them audited.

Eligibility criteria

To use Section 44AD, you have to meet a few conditions. Here’s the quick checklist.

Hindu Undivided Families (HUFs)
Partnership Firms (not LLPs)

Eligible businesses

Any small business except professions listed under Section 44AA(1)
Small traders, shop owners, wholesalers, retailers, contractors, commission agents (except brokers), cafe owners, service-based businesses structured as “business”, etc.

Who cannot opt in?

The following are excluded.

Professionals such as doctors, lawyers, architects, CAs, and engineers.
Insurance, stock, and real estate brokers, agents on commission.
Plying, hiring, or leasing goods carriages (under Section 44AE) Businesses.
LLPs
Anyone claiming deductions under Sections 10AA, 80HH to 80RRB
Businesses earning income outside India

Turnover limit under Section 44AD

This is where most people get confused, so let’s settle it. The turnover limit for section 44AD is Up to ₹3 crore. But there’s a condition.

At least 95 percent of your receipts must be through digital modes. If you don’t meet that 95 percent condition, the old limit of ₹2 crore applies. So the flow is simple:

Mostly digital payments? → Eligible up to ₹3 crore
Not mostly digital? → Eligible up to ₹2 crore

This rule encourages businesses to shift to digital payments.

How to calculate income under Section 44AD

The calculation is simple.

Example

Let’s say your turnover is ₹75 lakh.

60 lakh received digitally
15 lakh received in cash

Your income will be:

6 percent of 60 lakh = 3.6 lakh
8 percent of 15 lakh = 1.2 lakh

Total taxable income = ₹4.8 lakh

That’s it. No expense tracking. No depreciation calculations. Nothing complicated.

Books of accounts and audit requirement

One major advantage of Section 44AD is the freedom from maintaining books and getting audited.

If you opt for 44AD

If you want to declare lower income (Below 6/8 percent)

Then you must:

Maintain books
Get a tax audit done under Section 44AB

This defeats the purpose of opting into the scheme, so only do this if your margins are genuinely low.

The 5-Year Lock-In rule

This is the part most taxpayers miss. Once you opt for Section 44AD, you must continue using it for 5 years. If you exit early or declare lower income in any of these 5 years without an audit, you become ineligible for the next 5 years. So choose carefully. If your business has fluctuating profit margins, locking yourself into 44AD may not be the best idea.

Depreciation and deductions under Section 44AD

You don’t claim separate deductions for expenses or depreciation. The deemed income rate already accounts for them. However, depreciation is considered allowed, so the written-down value (WDV) of assets will reduce even if not shown separately.

Advance tax rules

Normally, businesses pay advance tax in four installments. Under Section 44AD, you have it easier. You pay only once, that too by 15th March of the financial year.

Drawbacks to keep in mind

It’s not perfect for everyone, though.

1. Lock-In Rule

Makes exit difficult if your business performance changes.

2. Inflexible expense structure

If your margins are genuinely lower than 6–8 percent, you may end up paying more tax.

3. Not available for professionals

Freelancers offering professional services need a different scheme (44ADA).

4. No separate deductions

You can’t claim expenses like rent, salaries, interest, etc., separately.
