No outward sales: You cannot have any sales from Business To Business, Business to Customer, exempt, and export sale invoices.
No purchases: You must not have any tax invoice where input tax credit can be availed.
No reverse charge mechanism (RCM): You cannot have any inward supply of goods or services under RCM.

The difference between no business activity and no GST liability

Taxpayers get confused when considering having no sales and having a Nil GST return.

No sales (but active purchases): When there are no sales during the month, but you pay rent for your office or subscriptions for the software through GST, then it's not a nil GST return, since you have ITC in such cases.
No business transaction (true nil): Only when the transactions don't include sales, purchases, reverse charges and ITC can you consider the return to be nil.

Priya owns an online consultancy firm. During May, she did not issue any invoice for the services provided to her clients. But she incurred a GST on her office internet expenses in the

When is nil GST return filing required?

After getting your GST identification number (GSTIN), you become eligible for filing the returns. nil GST return filing is essential for every return period wherein your business qualifies for the actual nil category.

This is because the GST portal works on a continuous flow pattern; it is not possible for you to make the current month's filing until you clear the filing from the previous month.

Forms and filing deadlines applicable

Based on your GST registration, you have to file nil filing through certain forms:

GSTR-1 (outward sales details): 11th day of next month in case of monthly filing and 13th day of the month following quarter in case of QRMP filing.
GSTR-3B (summary returns and tax payment): 20th day of next month in case of monthly filing and 22nd/24th day of the month following the quarter in case of QRMP filing.
CMP-08 (composition scheme statement): 18th day of month after the quarter.

How to submit GST nil return

To submit a nil return, you need just about 2 minutes. Individuals who want to submit GST nil return online may do it through the GST Portal or SMS.

Option 1: Using GST portal

Login: Log in to gst.gov.in using your credentials.
Go to dashboard: Go to services > Returns > Returns dashboard and select financial year and period.
Select return type: Click on either GSTR-1 or GSTR-3B.
Choose nil option: Choose the option to “file nil return” (this will be displayed on the screen if there is no data in any table).
Authenticate: Verify & file using EVC via OTP or DSC.

Option 2: Nil return through SMS

In case of genuine nil period, you do not even need to log in to the website. You have to send an SMS from your registered mobile number to 14409:

For nil GSTR-3B: SMS nil 3B <GSTIN> <MMYYYY> (example: nil 3B 07AAAAA0000A1Z5 052026).
For nil GSTR-1: SMS nil R1 <GSTIN> <MMYYYY>.

Yes, the statutory late fee is ₹20 per day (₹10 CGST and ₹10 SGST) applicable to every day past the due date as per Section 47 on late nil returns.

5. Can a nil GST return be corrected?

No, the GSTR-1 and GSTR-3B filing regulations in India don't allow any correction of a filed return. In case you make a mistake while making a nil return, when in reality, you had reportable invoices, the correction can be made only in the following tax period returns.
