Section 129 of the GST Act is not meant to impose penalties in a mindless manner if there is some procedural flaw in the process of movement of goods. Is intention to evade tax expressly mentioned in section 129?

What happened in Balaji Traders v. State of U.P.?

On October 6, 2023, the Allahabad High Court ruled on the case of M/s Balaji Traders and Another v. State of U.P. and Others.

The firm was registered as a dealer in cigarettes, pan masala and food-processing spices. The firm received an order from a dealer based in Nashik and raised a tax invoice dated November 18, 2022.

The transportation of goods was to be carried out by railways. The firm claimed that the Railway Receipt number was necessary for the proper completion of the e-way bill.

The owner went inside the Kanpur Railway Station to get the bookings done. The consignment, however, was kept in an e-rickshaw outside the railway station.

Goods were seized by GST. As per the taxpayer, the e-rickshaw driver told the officials that the owner was inside the railway station with the requisite documents. When the goods were seized, a penalty of ₹5,58,286 was levied.

What was the taxpayer’s explanation?

Balaji Traders maintained its position that the transaction was legitimate and was already supported by a tax invoice.

The main points put forward by the taxpayer were:

Tax invoice had been generated before interception.
Goods were in transit through legal means by rail.
Railway Receipt number is necessary to finalise the e-way bill.
Owner was present at the place to finalise the rail booking.
The driver of the e-rickshaw has notified the authorities regarding the matter.
Subsequent to this, documents in support and explanation were provided.
There was no intent to hide the transaction or avoid GST.

The taxpayer further stated that there was no mention of any finding as regards the intention to evade tax either in any of the notices or in the order passed for levy of penalty.

What did the GST department argue?

The Department argued that the required documents were not presented at the time of the seizure of the goods.

It argued that the transport of goods without the necessary documents amounted to a violation of the Goods and Services Act. The Department also raised concerns over the transaction not being recorded in the case of the absence of interception of the goods.

Thus, the High Court had to determine whether this suspicion was sufficient to impose penalties or whether the authorities were required to carefully assess the documents and explanations provided by the taxpayer.

What did the Allahabad High Court decide?

The Allahabad High Court has rejected both the penalty order as well as the order passed by the Appellate Authority.
