GST ITC on Company Cars: What the 2026 proposal could actually change

Nine years is a long time to wait for a tax break. That's roughly how long GST has kept businesses locked out of claiming Input Tax Credit (ITC) on passenger vehicles bought for employees, and now there's finally movement on the issue. In July 2026, the GST Council's Law Committee floated a proposal that could open the door to ITC on vehicles purchased in a company's name for employee use. It also touched on group health and life insurance for staff. Here's the catch, though: none of this is law yet. Not even close. Can companies claim GST ITC on Company Cars today?

In short, no. Under the current framework, Input Tax Credit is blocked on passenger vehicles seating up to 13 people (driver included) whenever they fall under Section 17(5)'s restricted list. The law does carve out a few exceptions, say, if the vehicle is being resold, used for passenger transport, driving instruction, or moving goods.

But if you're a company that just bought a sedan or SUV for an employee to drive to meetings? That GST you paid isn't coming back as credit, no matter whose name is on the registration.

What exactly is Section 17(5)?

Think of Section 17(5) as the GST law's "no, not this one" list. It spells out goods and services where you can't claim ITC, even if you've ticked every other box under the general rules.

For passenger vehicles specifically, whether ITC is blocked depends on two things: seating capacity and how the vehicle is actually used. And it doesn't stop at the purchase; the same section also restricts credit on insurance, servicing, repairs, and maintenance tied to those blocked vehicles.

What the Law Committee actually proposed in July 2026

The Law Committee's July 2026 recommendations reportedly cover three things:

Vehicles bought in a company's name specifically for employee use
Group health insurance policies for staff
Group life insurance policies for staff

This fits into a broader push to ease GST compliance and loosen some of the tighter restrictions businesses have dealt with for years. But a recommendation is just that- a recommendation. It still needs to clear the approval process before it changes anything on the ground.

Has the GST Council approved this?

No. Not yet. A Law Committee recommendation doesn't automatically become law; the GST Council has to approve it first, and then the amendments or notifications need to actually be issued. Until that entire chain plays out, the existing Section 17(5) rules keep applying exactly as they do today.

A real-world example: What this could mean for a ₹35 Lakh SUV

Let's say a company buys an SUV for ₹35 lakh, GST included, and the vehicle attracts 40% GST. Working backward to find the GST component:

(₹35 lakh × 40) ÷ 140 = ₹10 lakh

So around ₹10 lakh of that ₹35 lakh price tag is GST. Under today's rules, if this vehicle falls into the blocked category and it's for regular employee use, that ₹10 lakh simply isn't recoverable. If the proposal eventually becomes law and the vehicle qualifies under whatever final conditions get attached, that ₹10 lakh could turn into usable credit.

Note: ₹35 lakh here is the GST-inclusive price. If you just slap 40% straight onto ₹35 lakh, you'll land on ₹14 lakh, which is wrong. Always work the tax out of the inclusive price, not on top of it.

What about Insurance, Repairs, and Maintenance?

Buying the car is only part of the cost. Section 17(5) also blocks ITC on general insurance, servicing, and repair expenses connected to vehicles that fall under the restriction. So if your company runs a fleet of employee-use vehicles, you're not just eating the GST on the purchase; you're eating it on the upkeep too.

If the proposed changes go through, businesses will need to read the fine print carefully to see whether these related costs get swept in as well, or whether only the purchase itself qualifies. Don't assume it's an all-or-nothing deal.

When can you actually start claiming this?

There's no effective date on the table right now. None. For this to move from proposal to practice, you'll want to watch for five things:

GST Council approval of the recommendation
The formal amendment or notification
A specific effective date
Eligibility conditions attached to the credit
Transitional provisions for vehicles or expenses incurred before the change kicks in

Until all five pieces fall into place, you're still operating under the old rules.

If you're planning a big vehicle purchase or reworking employee benefits, don't jump the gun. Here's the sensible approach:

Keep applying Section 17(5) as it stands today
Don't claim ITC just because the proposal exists; it isn't approved
Keep an eye on GST Council announcements and follow-up notifications
Hold off on major vehicle decisions until the eligibility conditions are actually published
Revisit your insurance and maintenance costs once (and if) the change becomes official

For companies running larger fleets, even a partial shift in ITC eligibility could meaningfully change the real cost of keeping those vehicles on the road. It's worth tracking closely.

The bottom line

Section 17(5) has kept ITC out of reach on most employee-use vehicles for nine-plus years, regardless of whose name sits on the ownership papers. The July 2026 proposal could finally start chipping away at that for vehicles and for group insurance.

But right now, it's just a proposal. Nothing more.

Until the GST Council gives its approval and the actual amendments take effect, stick with the rules you already know. If this does eventually pass, it could meaningfully lower the GST burden on company vehicles and certain employee benefits, especially for businesses running sizeable fleets. Just how much depends entirely on what the final notification actually says.
